California: HIV Organ Transplant Bill Sent to Governor Schwarzenegger

Among recently passed bills awaiting the signature of Gov. Arnold Schwarzenegger is one that would prohibit insurance companies from denying coverage of organ transplants to HIV-positive patients. Assemblymember Paul Koretz (D-West Hollywood) introduced the measure, AB228. If Schwarzenegger approves the bill, it would be the first such law in the United States. AB228 moved from the Legislature on Aug. 29.

"The passage of AB228 sends a message to the nation that patients with HIV should not be denied access to organ transplantation simply because of their HIV status," said Koretz. "There are many reasons why a patient with HIV may not be suitable for a transplant, but the sole fact that they are HIV-positive is no longer considered a legitimate reason at many transplant centers."
