HIV-Positive Buffalo Man Faces Felony Charges; Positive Justice Project Urges 'Rational Response'

A 20-year-old man in Buffalo is facing four felony reckless endangerment charges after police say he allegedly had sex with several people without disclosing that he is HIV positive.

Housing Works, along with the Positive Justice Project, would like to remind journalists and others of the negative consequences of laws that criminalize HIV non-disclosure. While these prosecutions are often rooted in a desire to protect the public health, they actually undermine public health initiatives by discouraging testing and fueling stigma. They also put HIV-positive people at high risk of unjust prosecution.
