India's Top Court Refuses to Temporarily Suspend Ruling That Made Gay Sex Legal

July 21, 2009

India's Supreme Court on Monday refused to temporarily suspend a ruling by the Delhi High Court that struck down a law making sex between consenting adults of the same gender illegal. The Supreme Court said the lower court's July 2 ruling will remain in effect while it reviews a petition to reverse it. Hearings on that petition, which were filed by Hindu astrologer Sushil Kumar Kaushal, are set to begin on Sept. 14. As a result of the law, which carries a 10-year prison sentence, and widespread stigma, many gay people in India struggle to keep their sexual orientation secret.
