Gay Group Challenges Botswana Sodomy Law

May 4, 2009

In a case that aims to legalize same-sex relationships in Botswana, members of the officially banned Lesbians, Gays and Bisexuals of Botswana (Legabibo) have filed a challenge to the nation's sodomy law. "The law that criminalizes homosexuality violates the right to privacy and freedom of association," said Uyapo Ndadi, an attorney and the legal officer for the Botswana Network of Ethics, Law and HIV/AIDS, which is supporting the lawsuit. Botswana's appeals court ruled against a similar challenge in 2003, arguing the country was not ready to accept homosexuality. In 2007, the government refused to allow Legabibo to register as an officially recognized group, effectively outlawing it.
