My uncle's lover, guardian and beneficiary of my uncle's estate, leaves the fortune in turn to my father and my father's family as my uncles had agreed. Only he sets up a trust in which the fortune is allowed only to grow until my father's death when the ballooned capital would be divided among my father's three children. That wouldn't be so bad, and it does give us all 5000 dollars a year before tax. But the thing is, it stinks. My uncle's lover was dying of AIDS and was so ashamed of himself, he could only imagine his worth being measured in terms of the size of his post mortum portfolio. He saw it growing over future years as his physical being dimished daily. No one knew it was AIDS, until we saw it written on the death certificate. His alcoholism had ravaged his liver to begin with, and we all thought he was dying from the drink. It was the ultimate irony. I was already a year on monotherapy and knew I was positive for two years before he died. I had discussed it with him, hoping for some support and understanding as the only other gay man in the family, but he responded with trying to have me written out of the will. It would only be wasted on me. Luckily for me, the executor talked him out of it, recognizing it as just another alcoholic rage. I asked him once to leave something to AMFAR, but he said he couldn't let the word AIDS be seen on his will. I had to understand... Now almost 10 years with HIV, and 7 years since the man died, the trust is worth 2 million dollars. Dependant on the state, my income is minimal. My father doesn't like to talk about the trust-- it's dirty money. But it would make a world of difference to me. Even though I am named as beneficiary with share of one third in the capital, I can do nothing to tap into the trusts potential to provide far more income for all of us, and provide my security living with HIV. Or? What do you think. Does anyone know a good lawyer, or is this beyond judicial intervention... Raging Bull
