Legality issue

I was wondering if there was any legal responsibility of a doctor that disclosed my diagnosis to a visitor in a hospital room.
The story goes like this...
I was very ill with cmv and my intestines actually ruptured while in the hospital. The surgen came in and started asking me questions about my medical history while looking at my chart. At the front of the chart was a large note stating that no one except for staff is to talk about my status except for with my partner.
My father was visiting at the time and the doctor came in and didn't ask who was visiting he just started with the history questions and asked me how long I had been HIV Positive. He also didn't ask if I minded if the visitor was there while asking me questions. At that time I was very very sick and in septic shock so I didn't even think that maybe I should ask him to leave.
This has put a strain on my relationship with my father and step mother (even more so, she wont even hug me now)
Do you think it would be worth pursuing?

Hello. I had the same problem at the doctor's office. What I did was talk to my ID doctor and let her know what had happen she had the head of the hospital come and talk to me about that and I found out that it was a breach in my confidental rights . So you may want to take the same steps or talk with a lawyer to find out what your next step should be.

I agree with 12 years positive. Your physicians have a right to know your status but they do not have a right to disclose this to any 3rd parties. Your rights have been violated. I would talk with customer service at the hospital. All hospitals have a Risk Management department that deal with breech of patient confidentiality on the part of staff (MD's or others). I wouldn't be vindictive but I would certainly have the MD who did this be aware and accountable for his actions. By the way...I am HIV Positive and an RN working in a large university medical center.
