In most countries consent must be obtained prior to an HIV test being administered. The test is not routinely given prior to surgery, but a surgeon may request it, or ask the patient about their HIV status. If you are worried about your HIV status it is in your best interest to seek out anonymous testing as soon as possible, regardless of whether or not you proceed with the surgery. Be brave!

No. Hospitals do not routinely test for HIV prior to surgery. And in my experience, it is a request I have yet to hear from a surgeon. No one can test you for HIV without your prior WRITTEN consent to it. Doing so would amount to battery, not to mention a very serious violation of federal and state laws protecting your privacy. If you are concerned about your HIV status, it is in your best interest to be tested, but I always recommend ANONYMOUS testing for the initial test. Please be advised, that all health care providers are REQUIRED to implement universal precautions when dealing with blood and other body secretions capable of transmiting HIV and other pathogens. This is true at all times, and with all patients, not just when there's a concern about a person being infected with HIV. A need to "know" in order to be careful when handling or treating a patient, is NOT an excuse for requesting an HIV test per se, since like I said, all health care professionals (including surgeons, nurses, etc.) should be following universal precautions regardless... hope that helps! Scott
