If you are HIV-positive or have AIDS, and your prescription or medical information has been sold or disclosed by your pharmacy without your knowledge or permission, your privacy rights may have been violated, depending on the laws of the state where your pharmacy is located.
Many states have laws that generally prohibit the unauthorized disclosure of confidential HIV- or AIDS-related information. We believe that a sale or transfer of your prescription files to another pharmacy that you did not know about or consent to may violate these HIV/AIDS nondisclosure provisions, as well as other laws that apply generally to medical information, pharmacies and other health-care providers.
