Do I have a disability
Jun 2, 2001

While applying for a job and I am asked if I have a disability what should I say. I am only HIV positive with no physical limitations at the moment. The reason I am concerned is should my health deteriate over time, then claim an ADA disability later on, then they find out I had HIV all along, what would happen??

Thank you

Response from Ms. Franzoi

Have you been asked this question? I do not think it is legal in a job interview to ask about a person's medical history. The interviewer can ask if you would need any accomodations to do the job but he can't ask specific quesitons about your health. If you were or are asked this question, answer, "No."
