Pre-employement background check
Sep 24, 2013

Does a pre-employement background check show the person tested positive? I understand certain jobs require an HIV test, but I was wondering if the regular background check scope included CDC records and how would that work?

Response from Mr. Chambers

Under the Americans with Disabilities Act, you cannot be required to take a pre-employment physical exam unless you have first been given a firm job offer.

The purpose of the exam is to see if you are physically able to do the job so even if there is an HIV test (ask the examiner), as long as you can perform the job duties, they cannot withdraw the job offer. Also, most exams only give the employer a "yes" or "no" to being able to do the job. Again, ask your examiner what information the employer gets.

Good luck, Jacques
