Note that I am not an attorney. However, a review of the HIV statutes in both the California Health & Safety as well as the Insurance Codes, does not show any limitation on the mode of disclosure. Health & Safety Code 121015(b) does prohibit a physician or other medical person performing the HIV test from informing any other entity (e.g.reporting to CDC, local county health, etc) until the person has been "informed" of their status and the availability of counseling.
