can an employer force you out of insurance coverage
Oct 11, 2012

My husband's company voted that if you are married and your spouse can get insurance at their work. Then he would not be able to get insurance thru his work??

Response from Mr. Chambers

If that is group health insurance, then I do not believe it is legal for several reasons, including it's discriminatory. You may want to confirm that with your nearest federal Equal Employment Opportunity Commission (EEOC) office regarding being discriminatory.

Also, the nearest regional office of the US Dept. of Labor's Employee Benefits Security Administration office can tell you if that is a violation of ERISA, which governs employer provided welfare benefit plans.

Hopefully, you have such a statement in writing.

Good luck, Jacques
