If that is group health insurance, then I do not believe it is legal for several reasons, including it's discriminatory. You may want to confirm that with your nearest federal Equal Employment Opportunity Commission (EEOC) office regarding being discriminatory. Also, the nearest regional office of the US Dept. of Labor's Employee Benefits Security Administration office can tell you if that is a violation of ERISA, which governs employer provided welfare benefit plans.
