Group Insurance without HIV med coverage
May 28, 2012

My group insurance eliminated all "Tier III" drugs and therefore my HIV meds will no longer be covered. I live in Georgia - what options do I have - I want to work but can't afford to pay for the medications?

Response from Mr. Chambers

Wow, that's awful. Do you know if there are Tier III drugs that are not HIV related? If they only carved out HIV medications, you may have a legal argument under ERISA, as targeting specific medical conditions to restrict benefits is a violation of it. If so, you should contact your regional office of the US Department of Labor - Welfare and Benefits Division.

As far as other sources, there is an AIDS Drug Assistance Program in Georgia. You can get more information on it by clicking here.

You should also contact your local AIDS Service Organization. There may be other assistance specific to Georgia which could provide some assistance.

Good luck, Jacques
