New HIV diagnosis
Jan 30, 2012

I just learned of being HIV positive and have not seen a doctor yet. A little over a month ago I switched jobs and my health insurance coverage started two days ago. While it has not been over 63 days since my last coverage ended, is there still a potential concern seeing a doctor for testing/treatment so soon after the new coverage started?

Response from Mr. Chambers

Under HIPAA, as long as you have had continuous coverage, which means no gap in coverage longer than 63 days, they cannot apply a pre-existing conditions limitation to your coverage. They do not count the probationary period at your new employer before your health insurance actually starts.
