Individually purchased health insurance is regulated by states, so the answer depends on what state you are asking about. With the exception of a few states that guarantee insurance or offer annual open enrollments, I know of no insurance company offering broad medical coverage that will knowingly offer insurance for individual medically-underwritten coverage.
Employer provided insurance comes under federal law and employees otherwise eligible for health insurance can NOT be refused coverage because of their health or HIV status.
