Deception or Desperation
May 1, 2001

My question is..I have a pre-existing condition (hep c) and know I will be turned down if I apply for insurance. What if I don't disclose the illness? Can I use the insurance for other health problems? Or would I be cancelled if they found out? And how would they find out?

Response from Mr. Berg

Most policies have a 2 year incontestability provision allowing them to rescind coverage (and return premiums less any claim expenses paid) anytime during the first 2 years of coverage once it is discovered you misrepresented or omitted information on the application. In theory, you could wait out this period and just use it for other conditions. The big question is: can you get away with it?
