|LTD and 24 month limitation for mental disorder
Nov 2, 2010
I am in the open enrollment period and am considering wether to continue paying for Group LTD, which I've had for over 15 years. As part of this process I requested the group sponsor for a copy of the Certificate and Summary Plan Description. To my surprise it indicates that payment of LTD benefits is limited to 24 months if disability was caused or CONTRIBUTED to by "Mental Disorders". The prevalence depression in the HIV positive population is well documented, but the depression is usually secondary to the HIV. I wonder if LTD benefits would be subject to 24 month limit based on my HIV doctor's medical records documenting that I was prescribed an antidepressant? Thank you
Response from Ms. Franzoi
If you became disabled due to a medical illness related to your HIV status and not a depression diagnosis, even if you suffered from depression, the LTD benefits would continue beyond the 24 months based on your physical illness.
Should 2nd opinion be delayed until can be on insurance?
Paying into Insurance, and not getting benefits.
