health insurance cancellation (company sold)
Sep 17, 2009

My sister has had cobra health ins.for 9 months. The company she had worked for was just sold and she was told yesterday that her Tufts plan was cancelled 4 days ago. She was told from former employer that because there are no longer any employees Tufts cancelled the coverage.(State of MA.) She already has a necessary surgery scheduled for early October. What options does she have for any kind od coverage? And is this legal?

Response from Ms. Franzoi

If the buyer has no employees in the state and does not offer a plan that covers employees in that state, there would be no COBRA benefits available. She should check to see if there is a conversion right on the policy. If there is, she should exercise that option. If there isn't, she would be eligible to purchase a HIPAA policy from any insurer that sells individual policies in her area.
