Living Benefits

Hi, I was diagnosed about 5 years ago, and just started treatment. I have a life insurance for over 22 yrs, and I thought that I could apply for living benefits. However, my life insurance states that the doctor must certify that I suffer from a terminal condition that would result in my death within 9 months. Is that legally correct? Please advise. Thank you.
