If employee has exhaused 12 weeks FMLA & on approved leave of absence, can the employer terminate group sponsored life policy & require EOI when I return?

Yes. An employer is only obligated to continue medical and dental benefits and health reimbursement accounts during an FMLA leave. The employer is not required to continue life insurance or other health and welfare benefits during the leave. If you return at the end of the FMLA leave (12 weeks), the employer must reinstate your benefits as before which is why many employers continue the life, disability and other benefits during the FMLA leave because they require EOI for reinstatement. However, at the nd of the FMLA leave, the employer doesn't have to worry about this.
