| Insurance Co. Withdrawal from Individual Market Apr 5, 2006 I no longer work at age 63, living on 401K and early SS. My job was terminated 6 years ago. After COBRA expired, I acquired an individual HMO policy with United Healthcare of New York. I was diagnosed with AIDS a year after that, in 2002, and have been using that policy ever since for doctors and HIV medications. I have now received a letter from United Healthcare constituting "formal notice of our intent to terminate your coverage pursuant to individual market withdrawal. In the wake[!] of the merger between United Health Group and Oxford Health Plans, it has been decided that, as of October 1, 2006, United Healthcare of New York will no longer be active in the individual HMO market in New York, Therefore, your current coverage will terminate as of this date. You may apply for similar coverage from Oxford Health Plans. However, you may choose to purchase coverage from another carrier or HMO that offers individual coverage." Total shock and terror on my part. Of the million and one questions, will I be subject to a preexisting clause with a new company that will not pay for my HIV medical needs for one year? |

As long as you get coverage within 63 days of your UHC coverage ending, you will have "creditable coverage" as defined under HIPAA and a pre-existing condition clause will not apply. Applying for coverage with Oxford (because of the merger) might be your best option. | |||
