Is Medicare Considered Credible Coverage

Concerning your response to a question on 3/9/05 re: medicare counting as credible coverage, if I am reading your response correctly, the answer was "yes". I am getting a different answer from a prospective employer. Can you please tell me where I can get information to give to this prospective employer to set them straight? Thanks so much.

Medicare is considered Creditable Coverage under HIPAA. The Statutory and Regulatory provisions are found in ERISA 701 and Code Section 9801. In Regulation 2590.710-4, I quote, "Rules relating to creditable coverage-(a) General rules - (1) Creditable coverage. For purposes of this section, except as provided in paragraph (a)(2) of this section, the term creditable coverage means coverage of an individual under any of the following:...(iii) Part A or B of Title XVIII of the Social Security Act (Medicare)..."
