| Is Medicare Considered Credible Coverage Nov 22, 2005 Concerning your response to a question on 3/9/05 re: medicare counting as credible coverage, if I am reading your response correctly, the answer was "yes". I am getting a different answer from a prospective employer. Can you please tell me where I can get information to give to this prospective employer to set them straight? Thanks so much. |

Medicare is considered Creditable Coverage under HIPAA. The Statutory and Regulatory provisions are found in ERISA 701 and Code Section 9801. In Regulation 2590.710-4, I quote, "Rules relating to creditable coverage-(a) General rules - (1) Creditable coverage. For purposes of this section, except as provided in paragraph (a)(2) of this section, the term creditable coverage means coverage of an individual under any of the following:...(iii) Part A or B of Title XVIII of the Social Security Act (Medicare)..."
