| self insured company Aug 12, 2005 I'm HIV + and just started working for a self-insured company. My concern is that if I accept their insurance my status will become known and I will face possible discrimination for promotion or termination. I live in Texas an at-will employment state and this makes me very nervous. I believe HIV falls under ADA with regards to discrimination, but even with that protection what stops an employer from providing bad reviews which lead to a subsiquent termination? |

Under HIPAA, the administrator cannot disclose your condition to your employer. Many plans are self-insured and typically, an employer only wants to know how much he is spending on certain medical condtions not who has them. The penalties for breaching confidentiality under many laws, including HIPAA, makes employers reluctant to ask for this information. I would think having the coverage would be important for you. | |||||||||
