Secondly, I read with interest your response to the individual concerned about privacy violations at his/her local public health facility:
My understanding of HIPAA is that each institution is required to have some internal framework to ensure compliance and review complaints. Concerns for privacy and disclosure issues are handled by the designated "HIPAA Privacy Officer". Hopefully, the director of the clinic will be knowledgeable about how HIPAA policy is enforced within his/her organization and forward the complaint to the appropriate officer.
My primary concern is your suggestion that the reader approach the local EEOC chapter. Complaints about HIPAA privacy violations escalate from an institutional level directly to a federal office -- the Department of Health and Human Services' Office for Civil Rights. Dan, You've enlightened me. Thank you! I'm following through on the links and will use them to improve my responses. I wasn't aware of the requirement for an internal HIPAA privacy officer. That would indeed change my answer. Nancy
