Insurance formes versus Pre-employment forms
Jan 8, 2004

A question for Pre-employment. When you have a pre-employment physical done and you don't disclose your diagnose, can this cause problems on your actual insurance paperwork? Do the two interconnect? I know they usually ask your health history with a check list on pre employment exams. How do I get around this initially? Thank you Brenda

Response from Ms. Breuer

The purpose of a pre-employment physical is determining whether you are minimally fit to do the job. Can you fulfill the essential functions of the job? Can you fog a mirror? Then you have no obligation to disclose your diagnosis during a pre-employment physical.

What you may be thinking of is the need to be truthful on insurance application forms. No, there is no connection between a pre-employment physical and your insurance paperwork. If you run across a specific HIV question on your health history document, ask questions of the HR person who sees this form. Ask how the confidentiality of medical information is protected. Where does this form go? Who else sees it? Why?

Explain that you're sensitive to these issues because you know that medical information is private, and it's getting harder and harder for us to protect our privacy. Ask whether it's absolutely necessary for you to complete the form. Explain that you're a very private person, and you're not comfortable with this form sitting in your personnel file. Be friendly but confused. If you have to fill it out, skip the section about specific diagnoses. If they come back to you asking for more information, write to us again, telling us how many employees your employer has and whether the company is self-insured, okay?
