|Employer cancels health insurance while employee is on disablity

I have been on disability since August 2002. I just received a letter from my employer stating my heath insurance would be cancelled December 1,2002. I called my employer to ask if I had been terminated, he said NO. I asked "how can you cancel my insurance when health insurance is available to an employee for up to 30 days after termination, at which time the Cobra plan is offered?" He directed me to call this coming Monday and speak to my direct supervisor. My question: Can I be singled out on this health insurance issue (everyone else in the company has health insurance coverage)or is what they intend to do illegal, or discrimination? I have an appointment for a cat-scan of the brain on Dec. 3, 2002. Please advice ASAP Do I need to see an attorney on this matter, or is my employer within his legal rights to do this?

Your employer could have a policy of terminating coverage after a specified period of time on medical leave. However, you should be eligible for COBRA. Contact the Company and request your COBRA notification. If you don't receive it, contact an attorney or a legal aid group for assistance.
