Jul 25, 2000
My company was bought/merged etc. I have disclosed my
HIV status to my old employer, but wonder when our benefits
change if they can refuse me anything due to HIV?(Such as
Response from Ms. Breuer
Typically, when a company is bought, the buyer extends his benefit plans to the employees of the purchased company recognizing their original date of coverage under the seller's plans for purposes of any eligibility and/or pre-existing condition clauses in the benefit plans. However, you should check with the Benefits Department or the Human Resources Department in the new company to find out how the benefit coverage will work. You have no obligation to disclose your HIV status.
