Still confused about "pre-existing"
Apr 24, 2009
Since being diagnosed in 2004, I have been fortunate to use a state HIV medication program while being employed part time. I am extremely eager to return to my profession and previous income. I may have a full time job opportunity in another location that will allow me to enroll with Blue Cross Blue Shield. Two questions: 1) Can I be denied coverage, and 2) How do I manage the pre existing condition when I apply?

Response from Ms. Franzoi

If you were to become employed at a company and covered under the company's group health plan, if the plan has a pre-existing condition clause, treatment for HIV-related illnesses or medication would not be covered for a period of 12 months unless you had "Creditable Coverage" that could be applied towards that pre-existing exclusion period. I am not sure if your current state program would qualify. However, you should contact them as they would know whther or not that coverage is considered Creditable Coverage. If the employer offers a group health plan, as long as you are in the eligible class of employees, you would be eligible for the coverage, regardless of your health status.
