Can I be removed from Insruance
May 2, 2008

A little over a year ago I switched job, with no break in insurance, answered the HIV question (YES) on the new insurance forms and immediately was covered for my meds (HIV and another unrelated) This month I go a notice that coverage was to be continued, but they were investigating if this was a "pre existing condition" They have covered the medication for 13 months, can they drop me? Pretty worried about it, as I can't afford $1,600/month or quit my job and go on assistance.

Response from Ms. Franzoi

I am assuming that this is a group health plan. If it is, the plan cannot have a pre-exisitng condition exclusion period that is greater than 12 months (assumes enrollment when initially eligible). Based on this, I would speculate that the notice has more to do with your first 12 months of coverage not prospective coverage. In addition, if you had coverage prior to coverage on this job, you might have Creditable Coverage (discussed in other Q&As) which could be used. This might be what the insurance company is verifying.
