Health insurance just before ?
Apr 24, 2008

I work for a very large corporation and have health insurance. I have been having some health issues that I really think is HIV. Had a very high risk exposure 4 ago. I met a woman a couple of months ago I really like, and have disclosed to her my belief that I am HIV+. She says she will accept me even if I do have it. I have a doctors appt tommorrow to be checked. Would I be covered on her insurance if I am positive and we marry? Do I just get under her plan? Also, can you address the issue of applying for personal health insurance before actually being diagnosed positive, even just days, maybe 3 days before learning of the results? I know this is splitting hairs but need some excellent advice!

Help me in Texas !

Response from Ms. Franzoi

If you were to marry, she could add you to her group health plan as a spouse (assumes plan covers spouses). Even if her plan has a pre-existing condition clause in it, the exclusion period cannot be for more than 12 months and the plan must recognize prior coverage towards that 12 months unless you had a 63 day break in coverage. This would include coverage under your current group health plan. With respect to the application for an individual policy, placing an application and then getting a test 3 days later could pose a problem if you are determined to be HIV+. However, I cannot say whether or not it will. Why are you applying for an individual policy if you have group coverage through your employer? Typically, a group plan offered through an employer would provide better coverage at a lower cost than an individual plan.
