No insurance but not diagnosed
May 2, 2008
I believe that I may have contracted HIV. I have not been tested yet, but I do believe that I would test positive. I currently do not have any insurance through my job. However, I am expecting an offer for a new job and would be offered health insurance through my new job. If I accept the insurance, and then test positive after a few months of coverage, will they refuse to pay for any of my needed health care. Would they be able to claim that it is pre existing if I am initially diagnosed after the time that I receive coverage?
Would it be better for me to enroll, and then wait 12 months to get through the exclusionary period before going to get tested? Thank you

Response from Ms. Franzoi

If you accept a job that provides medical benefits and you enroll during the initial enrollment period and there are no medical records of your HIV status - tests, medications, doctor visits, etc. - there should not be a problem. For example, if you were to become employed today and become eligible for medical coverage as of 6/1/08 and you enroll in the plan, as long as there is no record of an illness in the 90 days prior to enrollment, no pre-existing condition clause would apply.
