Will my employer find out my status through insurance claims
Apr 24, 2008

I work for a company with about 6000 employees. They have a group insurance plan in which I participate. I was diagnosed HIV+ about 6 months ago. Will my employer be notified of hy HIV+ status? I am in management and regularly interact with HR managers. I'm worried that they will discover my status, at which point it's likely to become "public knowledge" throughout the company. Is there any protection that would prevent this disclosure, by name, or is it inevitable?

Response from Ms. Franzoi

You have protection under HIPAA. The insurance company and/or plan administrator cannot disclose information re your health conditions to the employer. this is protected health information under HIPAA>
