switching insurance in texas
Apr 24, 2008

I live in texas. Aetna has my policy (cobra) and is about to expire. My very small company wants me to fill out an app for a new company they are switching to Humana - The apps questions are trying to make me reveal my HIV status. What do i do? I can't disclose for fear of my job and insurance.

Response from Ms. Franzoi

I am not clear on what you have. I am assuming that you are not currently covered under your current employer's plan. (Or do you currently have this coverage in addition to COBRA?) When your COBRA coverage runs out, if you do not have coverage, you could apply for a HIPAA policy with any insurer that sells individual policies in your area. If you want to apply for (or keep, if that is the case) your current employer's coverage and it reqiuires completion of an application, you have no choice but to complete it. However, please remember that this is confidential information. The insurance company cannot disclose to your employer any health-related information. In addition, your employer, if he obtains any information, cannot discriminate against you beacuse of your health status.
