A man is hiv positive but does not disclose his status to a potential casual partner - ALTHOUGH INSISTs that that casual partner wear condom before penetrating him. Although he did NOT DISCLOSE his status BUT INSISTED on his casual partner wearing condom - does that absolve him from criminality. MUST HE DECLARE his status EVEN IF his partner wears condom?

Disclosure laws vary from state to state and country to country. In many locations disclosure is mandated even if you have ultra-safe sex! Review the information in the archives. We have a chapter devoted to HIV disclosure issues that discusses this issue in great detail.
