If someone did not use correctly a condom is it the same as doing unprotected sex?

It depends on what you mean by not using a condom correctly (you didn't put it over your shoe, did you?), but in a word, no. It is possible that if a condom was not used correctly (for instance, was put on inside out), that the condom would still prevent fluid contact between partners. The most important thing to consider when evaluating your risk for infection is fluid contact with mucous membranes.
Learn how to use a condom correctly. Follow instructions, read up on the available literature (HIV Prevention Basics), and practice (a penis, dildo, cucumber, whatever is available).
Making an attempt to use a condom, even if it is used incorrectly, is better than not using a condom at all.
