HIV FLIGHT tests
Sep 21, 2008

Hello Dr Young, Hope your well. I am HIV poz and wanted to know if airlines check for HIV when you apply for a job. Any advice would be appreciated as i am thinking of applying - Is it illegal to discrinate regardless of status. Thanks Luke

Response from Ms. Gabriel

Dr. Young has referred your question to the Workplace Forum. The answer to your second question is easy: yes, it is illegal to discriminate againt an employee (or prospective employee) because of a disability. The answer to the first part of your question is no. An employer cannot require an HIV test, it's none of their business. An employer (or prospective employer) can ask you if are able to complete the essential functions of your job with or without a reasonable accomodation but cannot ask you about your medical condition.
